Introduction

At ScopServ, we are committed to protecting the privacy of the personal information of our customers and users of our products and services. We take all reasonable measures to ensure the confidentiality of this information, including implementing rigorous policies and procedures to comply fully with Quebec's Act respecting the protection of information in the private sector, and all applicable laws and regulations in Canada, Europe, and South Africa.

ScopServ will also implement reasonable security measures against such risks as unauthorized access, collection, use, disclosure, copying, modification, or destruction of any personal information in its custody and control.

By personal information, the Laws mean any information about an individual that allows one to identify an individual. This includes your name, address, e-mail address, telephone number, gender, banking information, employment, health, or other information.

Privacy policy

This policy describes the principles and practices that ScopServ follows in handling personal information.

This policy applies to all customers and users of products, services, websites, applications and other offered by ScopServ.

In some cases, our products, and services, or those offered by a third-party service provider to our customers or users, have their own privacy policies.

This policy applies to all personal information about our customers and service users that we collect, use, or disclose.

This includes your name, address, e-mail address, method of payment for your services, how you use our services, including our websites, network usage and information collected by third parties, such as credit bureaus. This also includes IP addresses, URLs, data transmission information, the time you spend on the websites, and the time you spend on our applications and how you use them.

Consent

ScopServ considers your consent to the collection, use or disclosure of your personal information will be validly provided:

  1. If it is expressly given by your written or oral acquiescence;
  2. If you voluntarily provide personal information for an obvious purpose; or
  3. If you do not object to ScopServ's collection, use or disclosure of personal information within a reasonable time after ScopServ has clearly informed you, including through this Policy, of its intent and purpose.

In some cases, ScopServ may collect personal information about an individual without his or her consent, in accordance with the Acts or any other law or regulation permitting such collection.

For example, when you provide us with your address, it is understood that it is used for billing and service delivery purposes. However, if we process information of a more sensitive nature, such as credit checks, we will ask for your explicit consent. We will also obtain your explicit consent for marketing purposes.

It is always your choice to give ScopServ your consent. However, by choosing not to provide such consent, you may limit our ability to provide you with products, services or offers.

How and why, we collect personal information

The information we collect about you comes primarily from you. We do this when you subscribe to new products or services, when you make changes to your account, when you communicate with us by telephone, e-mail, or chat, when you visit one of our websites or use one of our applications, when you participate in our online forums or when you use our networks.

To offer you products and services, ScopServ collects personal information for several reasons, including the following:

●      To provide, bill and collect payment for products and services you have purchased from ScopServ;

●      To ensure that ScopServ's networks are functioning and to protect their integrity;

●      Confirm or validate your identity and ensure that your information is accurate and up-to-date;

●      Ensure compliance with our Terms of Use of Service and Fair Use Policy;

●      Comply with legal and regulatory requirements.

We may collect information to manage credit and business risks, collect overdue receivables, and detect, prevent, manage, and investigate fraudulent or other unauthorized or illegal activities.

Disclosure of information

We may disclose your personal information to comply with any court order, statute, or legal process, including to respond to any governmental or regulatory requests, in accordance with applicable laws, to enforce or apply our Terms of Use and other agreements, or if we believe that disclosure is necessary or appropriate to protect the rights, property or safety of ScopServ or others. These third parties are contractually obliged to keep personal information confidential, to use it only for the purposes for which we disclose it and to treat personal information according to the standards set out in the Policy and in compliance with the Laws.

Unless you provide your express consent, or such disclosure is required under a legal obligation, we will only disclose your personal information, without your consent, to organizations outside ScopServ in the following specific circumstances:

●      To a person who, in our reasonable judgment, is acting as your proxy to obtain information;

●      To another telephone company, when the information is required to provide telephone service and the communication is made on a confidential basis;

●      To a service provider or other agent retained by us, such as a credit reporting agency, for account management, collection of overdue invoices appearing on your account or to evaluate your creditworthiness.

Storage and retention

The personal information of our customers or users of our services may be stored or processed in Canada or abroad. It will be protected by appropriate measures, but may be subject to the laws of the country where it is stored.

ScopServ will retain your personal information only as long as necessary for the purposes for which it was collected, or long enough to allow you to access the information if it has been used in a decision that affects you or your account. Information that is no longer required will be destroyed or anonymized.

In certain circumstances, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymized data for legitimate purposes, without further notice or consent from you.

We do not collect or retain the following information:

●      The content of telephone conversations made possible by our networks (excluding calls received and recorded by our Customer Service staff, such recordings being made for quality control and training purposes);

●      The content of our customers' text messages and messages containing photos and videos belonging to them;

●      The content of applications used by our customers.

ScopServ does not sell information to third parties.

Data security

The security of your personal information is crucial to us. We have implemented appropriate and reasonable physical, organizational, contractual and technological security measures to protect your personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. We have taken steps to ensure that only those members of our staff who absolutely must have access to your personal information during their duties are authorized to access it.

Despite these measures, no method of transmission or storage is 100% secure or error-free. Unfortunately, we cannot guarantee absolute security. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately using the details provided below. If we become aware of a security breach affecting your personal information, we will inform you and the relevant authorities as soon as possible, in accordance with the Laws.

ScopServ Websites

This policy applies to information we collect, use or disclose on ScopServ websites.

Sites use cookies. A cookie is a small text file stored on the user's computer hard drive. This file is completely harmless and cannot contain viruses.

The sites may include links to third-party websites, plug-ins, services, social networks or applications. Clicking on these links or activating these connections may allow the third party to collect or share information about you. If you follow a link to a third-party site or use a third-party plug-in, please note that these third parties have their own privacy policies and we take no responsibility for these policies. We do not control these third-party sites and encourage you to read the privacy policy of each site you visit.

Through your use of the site, you agree to the terms and conditions of the policy. Any changes to this policy will be posted on this page.

Newsletter

This policy applies to information we collect and use about contacts who receive the ScopServ Newsletter.

We use a combination of technology to track and identify individuals who open the newsletter online. These tools enable us to verify e-mail addresses, as well as the dates and times messages are received and opened, so that we can optimize e-mail transmission and newsletter content.

User confidentiality is preserved at all times.

Access to and correction of your personal information

It is important that the personal information we hold about you is accurate and up-to-date. Please keep us informed if your personal information changes.

By law, you have the right to request access to and correct the personal information we hold about you. You may challenge the accuracy and completeness of your personal information and request that it be amended, as appropriate, by sending us a request for access or correction of personal information.

Requests for access or correction must be made in writing and addressed to the person responsible for access to information. The request must provide sufficient detail to allow ScopServ to process the request. ScopServ will respond within 20 days, unless extended by law.
